How Does it Work
Based on a National or EU Trademark Registration
To file an international trademark application, you first need a basis such as a national trademark registration, an EU trademark registration, or a pending application for either. If you already have a UK trademark or have applied for one, you can extend it internationally under the Madrid System by submitting an international application.
When extending a national trademark to other countries, the details in both the national and international applications must align. You’re not obligated to cover all goods and services listed in your national registration, but you can only register for the same or a smaller scope of goods and services.
Online Filing
To submit an international trademark application, you’ll file it online through UKIPO. The application allows you to select specific countries where you want protection, choosing from over 90 Madrid System member nations. UKIPO reviews the application for compliance and forwards it to WIPO (World Intellectual Property Organization) for further processing. With Brexit’s implications, EU trademarks and related international applications now include measures to protect existing rights, such as automatic conversion of EU trademarks to UK trademarks or the ability to file UK applications with retained priority dates within nine months post-transition. If you submit your international application within six months of filing for UK registration, you can claim priority. This ensures that the trademark’s protection date remains consistent across all selected countries. Nearly all member nations of the Treaty of Paris and World Trade Organization allow priority claims.
Assessment by WIPO
Once forwarded by UKIPO, WIPO evaluates your application to verify compliance with essential requirements. These include clear descriptions of goods and services and payment of the necessary fees. Upon meeting all formalities:
- The trademark is registered in the international database.
- It is published in the WIPO Gazette of International Marks.
- Notifications are sent to trademark offices in the selected countries.
The respective national or regional authorities then conduct independent examinations of your application.
Individual Country examination
Each country’s trademark office assesses the application independently. The outcomes can be:
- Your trademark is registered for all requested goods and services.
- Registration is granted for some goods and services.
- Registration is denied entirely.
